I looked at the chip on the NIC, went to SMC's website, downloaded the driver, went to update the driver, and picked it, and it doesnt use it. Windows says it didnt find a driver. Can i force it to use the driver? or is there something wrong with windows? or is the card just bad?

With the card installed does the add new harware wizard start and detect the card on startup?

If so create a new file in "My Documents" and extract the contents of the winzip driver file you downloaded to it then point the new hardware wizard to the file
