Modem Makes "line Out" Phone Line Busy

I have a phone line running into my modem (modem1) to the "line in" port and then a line running from the "phone" port to a splitter, which in turn connects to a phone & another modem (modem2). My problem is that modem1 makes the "phone" port line busy whether it is online or not (for both the phone and modem2). Sorry to be confusing. I've narrowed this down to a modem and/or software problem because the phone isn't busy if the splitter is connected directly to the phone line and my laptop are connected to the splitter, so the splitter and lines are fine, it's the modem where the problem lies. I've read that this could be caused by a modem which was struck by lightening, however i've hooked up two different pc's (different modems) into the same configuration and had the same problem both times. This configuration has worked before, but then all of the sudden stopped working. Is there something in Windows 2000 Pro that uses the phone line? My ISP is AOL and i'm running AOL 9.0. Does AOL 9.0 always have a connection to the phone line even when not signed on? I'm stuck. Thanks for any help.

looking in to this I think it as to do with aol 9.0 but i want to make sure it is and if there is a fix for it

come to think of it, I doubt it's aol 9.0 specifically, however. I guess I could uninstall AOL and find out. I also had the same problem on a second pc, which doesn't have aol 9.0...I think it has 7.0. I'll uninstall aol and see if that works, but since it's my ISP, I will eventually need to reinstall it <_<

changed modem(2) and that seemed to be the problem...giving the busy signal. Lightning may have messed it up, something else could have happened, but everything works now.
