uninstalling eset nod32

I have a friend that brought her laptop to me and wanted me to figure out if there was anything wrong with it, well I cleaned up a few things and eventually wanted to uninstall eset nod32 antivirus 5 and put the newest version 6 on there, after uninstalling 5, the program is gone from the uninstall menu in the control panel and even from another program called your uninstaller, but the kernel service for eset is still running and when I try to stop the service it says access denied as if I don't have admin rights, there is only one account on the computer, its brand new, windows 8(which I find to be crap) if I try to delete registry keys, I'm denied access, is there malware or something that could be causing this??
