No Sound... Sometimes

I have a Toshiba laptop and often times I'll turn it on and there won't be any audio. My sound driver is a Realtek AC97. The speaker icon will appear on the bottom, but the volume icon is faded out and it won't work. When I double click on the speaker, the volume control isn't even there just Wave, SW Synth & CD Player.

I tried upgrading the driver and it seemed to help for a day or two, then it started happening again. Sometimes I'll turn on computer and it will work fine, then the next time it won't. Any idea why the driver keeps acting like this? I've updated the computer with all the latest Toshiba BIOS fixes.

The headphone jack won't work either when this occurs.. there's no audio at all. Definitely not a speaker short or problem.
