Is Winfixer Malware or Not?

I have had problems for about 2 months, ever since Trojan.vundo infected my machine. I got rid of the Trojan, but I still keep getting bugged by Winfixer with these annoying alert messages, even though I de-installed it, never having chosen to install it in the first place.

My question is this: Trend Micro insists that Winfixer is a legitimate company. I read on these forums that it is a source of malware. Which is it? Does a legitimate company force itself onto computers or not?

I can't get rid of bak.dll It is in my Windows directtory. I run Hijack this to delete on reboot and it is still there. I can't delete or rename it. Trend micro identified it as belonging to winfixer. I would like to know how I can get rid of it as it is a BHO object that I can't kill in Microsoft Anti-spy either.
