You must have looked at the wrong card, there is no way nVidia will release a 10" mid range card.

the "exhaust" from the card will be touching the CPU HSF (my HSF is huge) so yea.

That fan faces downwards, not upwards.

well, ive read some reviews about the card im getting, and ive read that it might over heat. any ideas on any Fans i should get?

I'd just recommend getting a dual slot cooler, I really dislike single slot coolers.

could you give a link to a dual shot cooler?

another reason i think getting a 9600gt is bad is that my other gear will be holding back the 9600gt

That's like saying "I don't want one fast person on the relay team, since the other members are slow." Of course the team might not win, but they have a much better shot with one fast person than with another slow person. :)

The 9600GT is around the same size as the 8800GT, which is 9 inches long. If you have room for it, I'd strongly recommend it as it is about 90% more powerful than the 8600GTS you are considering, yet only about $10-$20 more (not including the MIR, as there will certainly be some available for the 9600GT at some point as well).
