yes

Technically he wasnt airborne when he died, since he died of hypothermia, he was already dead when he was falling out of the plane

Yes but if he died of hypothermia then it ould have been in the flight unless the plane was coming from the arctic amd he would have been airborne in the plane when he died.

also...concidering that the plane lowers it's landing gear before it lands (most of the time)...then he was airborne when he died
